Terms of Use

These Terms apply to the Platform, including website and mobile app access, account registration, property search, saved listings, communications, and any MLS® VOW Data or other real estate information made available through the Platform. If you do not agree to these Terms or the Privacy Policy, do not register for or use the Platform.

GeoHouse is a technology company. GeoHouse is not a real estate brokerage, does not provide licensed real estate services, and does not represent buyers, sellers, lessors, or lessees in any transaction. Real estate services available through or in connection with the Platform are provided by the Brokerage and its licensed REALTORS®.

The Brokerage is the MLS® VOW Participant/brokerage whose customers receive access to MLS® VOW Data through the Platform. GeoHouse provides technology services for the Platform under the Brokerage's supervision and accountability and does not participate as a brokerage in real estate transactions.

For purposes of these Terms, “Boards” means Greater Vancouver REALTORS® (GVR), the Fraser Valley Real Estate Board (FVREB), the Chilliwack & District Real Estate Board (CADREB), the BC Northern Real Estate Board (BCNREB), and any successor or related real estate board or association whose rules, agreements, or data apply to the Platform.

Before you may access MLS® VOW Data, you must expressly acknowledge and agree, in favour of the Brokerage, GeoHouse as service provider, and each applicable Board, that:

• you have received, read, and understood the British Columbia Real Estate Association form entitled “Privacy Notice and Consent”;
• you acknowledge entering into a lawful REALTOR®/consumer or REALTOR®/client relationship with the Brokerage or its licensed REALTOR®, as applicable;
• all data obtained from the MLS® VOW is intended for, and may only be used for, your personal, non-commercial use;
• you have a bona fide interest in the purchase, sale, or lease of real estate of the type offered through the MLS® VOW;
• you will not, and will not permit or assist any other person to, directly or indirectly:

1. copy, redistribute, or retransmit any MLS® VOW Data or information provided through the Platform;
2. display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any MLS® VOW Data to another person;
3. engage in Scraping, including screen scraping or database scraping, data mining, or any other activity intended to collect, store, reorganize, summarize, or manipulate MLS® VOW Data or related data;

• you acknowledge each applicable Board's ownership of, and the validity of its proprietary rights and copyright in, MLS® VOW Data and listing information; and
• you authorize each applicable Board and its duly authorized representatives to access the MLS® VOW and your information provided to the Brokerage or through the Platform for the purposes of verifying compliance with and pursuing enforcement of these Terms and all applicable rules, regulations, bylaws, policies, and laws.

To access MLS® VOW Data through the Platform, you must register and provide accurate information, including your name and a valid email address. You may also be asked to provide a phone number, street address, or other information at the option of the Brokerage or as required for compliance.

Your username and password are unique to you. Your password and access to MLS® VOW Data expire no later than 30 days after issuance and are not automatically renewed. On password issuance and renewal, a confirmation email will be sent to your registered email address; access is granted or restored only after you acknowledge receipt by clicking the confirmation link.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not share, transfer, sell, or sublicense your account. You must notify us immediately at contact@geohouse.io if you suspect unauthorized access or use.

You may not use the Platform for any unlawful, commercial, competitive, automated, or unauthorized purpose. Without limiting the foregoing, you may not use bots, crawlers, scripts, bulk downloads, scraping tools, reverse engineering, security circumvention, denial-of-service activity, misleading registration information, account sharing, harassment, spam, or any activity that could impair the Platform or violate Board rules, applicable law, or another person's rights.

The Platform limits the number of listings returned in response to any single search to no more than 100, in accordance with Board rules.

MLS® VOW Data and listing information made available through the Platform is supplied by the applicable Boards under agreements and rules governing the Brokerage's MLS® VOW access. GeoHouse does not generate or own MLS® VOW Data; GeoHouse displays it as a technology service for the Brokerage.

Listing information is deemed reliable but is not guaranteed accurate by the Boards, the Brokerage, or GeoHouse. The Boards assume no responsibility for its accuracy. You should independently verify information that is important to your real estate decisions with the Brokerage or another qualified professional.

MLS® VOW Data is refreshed at least once every twenty-four (24) hours, and the Platform displays the date of the most recent update where listing data is shown.

The Brokerage, GeoHouse, and the Boards may withhold, remove, restrict, or correct any listing, property address, field, disclaimer, or other information where required or permitted by Board rules, seller opt-out directions, applicable agreements, law, security needs, or data-source requirements.

GeoHouse owns or licenses the Platform software, design, layout, text, graphics, and other non-listing content made available by GeoHouse. The Brokerage, Boards, CREA, licensors, and other third parties retain their respective rights in their marks, data, content, and materials.

MLS® VOW Data and listing information are protected by copyright, database, contractual, and other rights and are made available only for your private, personal, non-commercial use under these Terms. No rights are granted except the limited right to use the Platform as permitted by these Terms.

The trademarks REALTOR®, REALTORS®, and the REALTOR® logo are controlled by The Canadian Real Estate Association (CREA) and identify real estate professionals who are members of CREA. The trademarks MLS®, Multiple Listing Service®, and associated logos are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA. Used under licence.

The Platform may contain links to, integrations with, or content from third-party services such as identity providers, map providers, analytics providers, hosting providers, app stores, payment processors, open-data sources, or websites operated by others. Those third parties are responsible for their own services, terms, privacy practices, and content.

Portions of non-MLS data displayed through the Platform may be made available under open government or other third-party licences, including licences published by British Columbia municipalities or public authorities. MLS® VOW Data remains subject to the separate restrictions in these Terms and applicable Board rules.

The Platform provides technology tools and information access. It does not provide legal, financial, mortgage, tax, appraisal, home inspection, engineering, insurance, investment, or licensed real estate advice from GeoHouse. You should consult the Brokerage, a licensed REALTOR®, or another qualified professional before relying on information for a transaction.

GeoHouse does not warrant that the Platform will be uninterrupted, error-free, secure, compatible with every device, or free from defects, viruses, delays, omissions, or data-source errors. Nothing in these Terms limits rights that cannot be limited under applicable law.

To the maximum extent permitted by law, GeoHouse will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic damages, including loss of profits, loss of goodwill, loss of data, loss of opportunity, or real estate transaction losses, arising from or relating to the Platform or these Terms.

You agree to indemnify and hold harmless GeoHouse, the Brokerage, the Boards, and their respective directors, officers, employees, representatives, contractors, and licensors from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your breach of these Terms, misuse of MLS® VOW Data, unauthorized account use, infringement of rights, or violation of law.

We may suspend, restrict, or terminate your account or access to the Platform, with or without notice, if GeoHouse, the Brokerage, or any Board reasonably believes that you breached these Terms, your account has been compromised, MLS® VOW Data has been misused, scraping may have occurred, or suspension is needed to comply with Board rules, agreements, security requirements, or law.

If the Brokerage's right to operate the MLS® VOW is suspended, expires, or terminates, or if a Board requires changes, suspension, deletion, or cessation of access, the Platform may immediately stop displaying MLS® VOW Data or may change without prior notice. GeoHouse and the Brokerage may also preserve, disclose, or delete records as required by Board rules, applicable agreements, and law.

We may amend these Terms from time to time by posting the amended Terms on the Platform with a revised effective date. If amendments materially affect MLS® VOW access or your rights and obligations, we may notify you by email or require you to re-acknowledge the amended Terms before continuing to access MLS® VOW Data.

These Terms and any dispute arising from or relating to the Platform are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law rules. Subject to any mandatory consumer protection rights, disputes will be brought in the courts located in British Columbia.
